1. Definisi

  • "Layanan" berarti platform CRIVE, termasuk aplikasi mobile dan situs web crive.app beserta seluruh fiturnya
  • "Pengguna" atau "Anda" berarti setiap individu atau entitas yang mengakses atau menggunakan Layanan
  • "Perusahaan", "kami", "milik kami" berarti PT Vintora Teknologi Indonesia
  • "Konten" berarti teks, gambar, video, atau materi lain yang dibuat, diunggah, atau disebarluaskan melalui Layanan
  • "Kredit" berarti unit virtual dalam Layanan yang digunakan untuk mengakses fitur berbasis AI
  • "Poin" berarti unit reward internal (1 Poin Internal = Rp5)
  • "Poinmate" berarti program earning berbasis passive income sharing (1 Poin Poinmate = Rp10)

2. Penerimaan Syarat

Dengan membuat akun CRIVE, mengunduh atau menggunakan aplikasi, atau mengakses situs web crive.app, Anda menyatakan bahwa: (a) Anda berusia minimal 17 tahun; (b) Anda memiliki kapasitas hukum untuk mengikat diri; (c) Anda membaca, memahami, dan menyetujui S&K ini.

3. Akun dan Keamanan

Untuk menggunakan fitur penuh Layanan, Anda harus membuat akun. Anda bertanggung jawab untuk:

  • Menjaga kerahasiaan kredensial akun Anda (email, kata sandi)
  • Memberikan informasi yang akurat, lengkap, dan terkini saat pendaftaran
  • Segera memberitahu kami melalui support@crive.app jika terjadi akses tidak sah
  • Semua aktivitas yang terjadi di bawah akun Anda

Kami berhak menangguhkan atau menghapus akun yang melanggar Syarat & Ketentuan ini.

Perlindungan Data: Pengelolaan data pribadi Anda tunduk pada UU PDP No. 27/2022 dan Kebijakan Privasi kami.

4.3 Ketentuan Kredit

  • Kredit digunakan untuk setiap operasi AI: generasi teks, gambar, video, dan analitik
  • Kredit rollover menggunakan metode FIFO: Rollover → Kredit Dasar → Bonus → Top-up
  • Kredit yang telah dibeli tidak dapat dikembalikan (non-refundable) kecuali kegagalan sistem

4.4 Check-in Harian

Poin harian direset setiap pukul 07:00 WIB: Free 35 | Premium 50 | Professional 65 | Elite 80 | Expert 100 | Enterprise 100.

5. Program Poinmate

Program Legal: Poinmate adalah program passive income sharing yang 100% legal.
  • Program aktif setelah 5.000 MAU (Monthly Active Users)
  • Free user dapat mengumpulkan Poinmate TETAPI tidak dapat withdrawal sampai upgrade
  • Penarikan minimum: 5.000 poin | Biaya: Rp 1.000 | Proses: 3–5 hari kerja
  • 1 Poin Poinmate = Rp 10. Earning bervariasi berdasarkan kondisi jaringan
  • BASE_POINMATE = 138 (FROZEN). Multiplier: Free 1× | Premium 2× | Professional 3× | Elite 4× | Expert 5× | Enterprise 5×
  • JAMINAN PRIVASI: ZERO browsing data dikumpulkan. Kill switch tersedia.
  • Verifikasi provider berkala Q2/Q3/Q4 sesuai ADR-015
  • Honeygain: Android+Desktop only, iOS EXCLUDED per CEO-029

6. Konten dan Hak Kekayaan Intelektual

6.1 Konten Milik Pengguna

Anda mempertahankan semua hak atas konten yang Anda buat. Dengan mengunggah konten, Anda memberikan lisensi terbatas, non-eksklusif, bebas royalti untuk menyimpan dan mendistribusikan konten tersebut semata-mata untuk penyediaan Layanan.

6.2 Konten Berbasis AI

Konten AI dihasilkan menggunakan model pihak ketiga (Gemini 3.1 Pro, DeepSeek V3.2, Groq Llama 3.1, ElevenLabs, Suno). Anda memahami bahwa:

  • Konten AI-generated mungkin tidak selalu akurat atau sesuai untuk tujuan tertentu
  • Anda bertanggung jawab penuh atas penggunaan dan publikasi konten AI-generated
  • CRIVE tidak memberikan jaminan keunikan atau kebebasan hak cipta atas konten AI

6.3 Konten yang Dilarang

  • Konten melanggar hukum Indonesia termasuk UU ITE
  • Ujaran kebencian, diskriminasi, kekerasan, pornografi
  • Konten menipu, menyesatkan, spam, phishing, malware
  • Konten melanggar privasi, hak cipta, atau merek dagang

6.4 Pelaporan Pelanggaran Hak Cipta (DMCA)

Notifikasi DMCA ke legal@crive.app. Kami menindaklanjuti dalam 14 hari kerja.

6.5 Persetujuan AI Training (D10)

Secara default, persetujuan AI training aktif (ai_training_consent = TRUE). Anda dapat menonaktifkan ini kapan saja melalui Settings > Privacy.

  • Jika aktif: konten Anda (kecuali 7 kategori sensitif) dapat digunakan untuk meningkatkan model AI CRIVE
  • Jika nonaktif: konten Anda TIDAK digunakan untuk pelatihan AI dalam kondisi apapun
  • 7 kategori data sensitif yang TIDAK PERNAH digunakan untuk AI training: data keuangan, data kesehatan, data hukum, dokumen identitas pemerintah, data biometrik, data anak (<18 tahun), data keyakinan agama/politik
  • Persetujuan dapat diubah kapan saja — perubahan berlaku segera untuk data baru

7. Pembayaran dan Penagihan

  • Pembayaran diproses melalui Midtrans (PRIMARY), Xendit, Apple App Store (StoreKit 2), dan Google Play Store (GPB v7)
  • Langganan diperbarui otomatis kecuali dibatalkan minimal 24 jam sebelum perpanjangan
  • Harga dapat berubah dengan pemberitahuan 30 hari sebelumnya
  • Top-up kredit yang sudah dibeli tidak dapat dikembalikan (non-refundable)
  • Pembatalan dapat dilakukan kapan saja; akses berlaku hingga akhir periode yang dibayar
  • Mata uang: IDR (Rupiah Indonesia) ONLY per ADR-013

8. Penghentian Layanan

8.1 Penghentian oleh Pengguna

Anda dapat menghapus akun kapan saja melalui menu Hapus Akun. Penghapusan permanen setelah grace period 30 hari. Selama grace period, akun dapat dipulihkan via support@crive.app.

8.2 Penghentian oleh Perusahaan

Kami berhak menangguhkan atau menghentikan akun dalam hal: pelanggaran material S&K, aktivitas ilegal, kegagalan pembayaran berulang, atau permintaan otoritas hukum.

Penghapusan Data: Saat penghentian akun, data pribadi dihapus menggunakan Cryptographic Erasure dengan masa tenggang 30 hari, sesuai Pasal 44-46 UU PDP. Data transaksi keuangan disimpan 5 tahun untuk kepatuhan perpajakan.

9. Integrasi Platform Media Sosial

CRIVE mengintegrasikan berbagai platform media sosial. Dengan menghubungkan akun Anda:

  • Anda memberikan izin CRIVE mengakses dan memposting konten sesuai OAuth
  • Anda tetap tunduk pada S&K masing-masing platform
  • Anda dapat mencabut akses kapan saja melalui pengaturan platform
  • CRIVE tidak bertanggung jawab atas perubahan kebijakan API platform

10. Batasan Tanggung Jawab

Sejauh diizinkan hukum, Perusahaan tidak bertanggung jawab atas: kerusakan tidak langsung, kehilangan data/keuntungan, gangguan force majeure, ketidakakuratan konten AI. Total tanggung jawab tidak melampaui jumlah yang telah Anda bayarkan dalam 12 bulan terakhir.

11. Hukum yang Berlaku dan Penyelesaian Sengketa

S&K ini diatur oleh hukum Republik Indonesia. Sengketa diselesaikan melalui:

  1. Negosiasi langsung antar para pihak (30 hari)
  2. Mediasi jika negosiasi gagal
  3. Pengadilan Negeri Jakarta Selatan
Kepatuhan Regulasi: S&K ini tunduk pada UU PDP No. 27/2022, PP tentang Penyelenggaraan Sistem dan Transaksi Elektronik, serta Kebijakan Privasi CRIVE.

12. Perubahan Syarat & Ketentuan

Kami berhak mengubah S&K ini kapan saja. Perubahan material diberitahukan 30 hari sebelum berlaku melalui email atau notifikasi dalam aplikasi.

1. Definitions

  • "Service" means the CRIVE platform, including its mobile application and website crive.app
  • "User" or "You" means any individual or entity accessing or using the Service
  • "Company", "we", "us" means PT Vintora Teknologi Indonesia
  • "Content" means text, images, videos, or other material created or distributed through the Service
  • "Credits" means virtual units used to access AI-powered features
  • "Points" means internal reward units (1 Internal Point = Rp5)
  • "Poinmate" means the passive income sharing earning program (1 Poinmate Point = Rp10)

2. Acceptance of Terms

By creating a CRIVE account, downloading or using the application, or accessing crive.app, you represent that: (a) you are at least 17 years of age; (b) you have the legal capacity to enter into a binding agreement; (c) you have read, understood, and agree to these Terms.

3. Account and Security

To use the full features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your credentials (email, password)
  • Providing accurate, complete, and current information at registration
  • Promptly notifying us at support@crive.app of any unauthorized access
  • All activities occurring under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Data Protection: Your personal data management is subject to UU PDP No. 27/2022 and our Privacy Policy.

4. Subscription Plans and Credits

4.3 Credit Terms

  • Credits are consumed for each AI operation: text, image, video generation, and analytics
  • Rollover credits use FIFO method: Rollover → Base → Bonus → Top-up
  • Purchased credits are non-refundable except in cases of system failure

4.4 Daily Check-in

Daily points reset at 07:00 WIB: Free 35 | Premium 50 | Professional 65 | Elite 80 | Expert 100 | Enterprise 100.

5. Poinmate Program

Legal Program: Poinmate is a 100% legal passive income sharing program.
  • Program activates after 5,000 MAU (Monthly Active Users)
  • Free users may accumulate but NOT withdraw until upgrading to a paid plan
  • Minimum withdrawal: 5,000 points | Fee: Rp 1,000 | Processing: 3–5 business days
  • 1 Poinmate Point = Rp 10. Actual earning varies based on network conditions
  • BASE_POINMATE = 138 (FROZEN). Multiplier: Free 1× | Premium 2× | Professional 3× | Elite 4× | Expert 5× | Enterprise 5×
  • PRIVACY GUARANTEE: ZERO browsing data collected. Kill switch available.
  • Quarterly provider verification Q2/Q3/Q4 per ADR-015
  • Honeygain: Android+Desktop only, iOS EXCLUDED per CEO-029

6. Content and Intellectual Property

6.1 User Content

You retain all rights to content you create. You grant the Company a limited, non-exclusive, royalty-free license to store and distribute such content solely for providing the Service.

6.2 AI-Generated Content

AI content is generated using third-party models (Gemini 3.1 Pro, DeepSeek V3.2, Groq Llama 3.1, ElevenLabs, Suno). You understand that:

  • AI-generated content may not always be accurate or suitable for specific purposes
  • You are fully responsible for the use and publication of AI-generated content
  • CRIVE makes no warranty regarding uniqueness or copyright freedom of AI content

6.3 Prohibited Content

  • Content violating Indonesian law including UU ITE
  • Hate speech, discrimination, violence, pornography
  • Deceptive, misleading content, spam, phishing, malware
  • Content infringing privacy, copyright, or trademarks

6.4 Copyright Infringement (DMCA)

DMCA notices to legal@crive.app. We will respond within 14 business days.

6.5 AI Training Consent (D10)

By default, AI training consent is enabled (ai_training_consent = TRUE). You may disable this at any time via Settings > Privacy.

  • If enabled: your content (excluding 7 sensitive categories) may be used to improve CRIVE AI models
  • If disabled: your content is NOT used for AI training under any circumstances
  • 7 sensitive data categories NEVER used for AI training: financial data, health data, legal data, government ID documents, biometric data, children's data (<18), religious beliefs/political views
  • Consent can be changed at any time — changes take effect immediately for new data

7. Payment and Billing

  • Payments processed through Midtrans (PRIMARY), Xendit, Apple App Store (StoreKit 2), and Google Play Store (GPB v7)
  • Subscriptions auto-renew unless cancelled at least 24 hours before renewal
  • Prices may change with 30 days prior notice
  • Purchased top-up credits are non-refundable
  • Cancellation available at any time; paid access remains until end of paid period
  • Currency: IDR (Indonesian Rupiah) ONLY per ADR-013

8. Termination

8.1 Termination by User

You may delete your account at any time via the Delete Account menu. Permanent deletion after 30-day grace period. During grace period, account can be restored via support@crive.app.

8.2 Termination by Company

We reserve the right to suspend or terminate your account for: material breach of these Terms, illegal activity, repeated payment failure, or legal authority requests.

Data Deletion: Upon account termination, personal data deletion follows Cryptographic Erasure with a 30-day grace period, per Articles 44-46 UU PDP. Financial transaction data retained 5 years for tax compliance.

9. Social Media Platform Integration

CRIVE integrates various social media platforms. By connecting your accounts:

  • You authorize CRIVE to access and post content per OAuth permissions
  • You remain subject to each platform's own Terms of Service
  • You may revoke CRIVE access at any time through platform settings
  • CRIVE is not responsible for changes in platform API policies

10. Limitation of Liability

To the extent permitted by applicable law, the Company shall not be liable for: indirect, incidental, special, or consequential damages; loss of data, profits, or revenue; service interruptions caused by force majeure; inaccuracy of AI-generated content. Total liability shall not exceed amounts paid by you in the preceding 12 months.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Disputes will be resolved through:

  1. Direct negotiation between parties (30 days)
  2. Mediation if negotiation fails
  3. South Jakarta District Court
Regulatory Compliance: These Terms are subject to UU PDP No. 27/2022, Government Regulation on Electronic Systems and Transactions, and the CRIVE Privacy Policy.

12. Changes to Terms of Service

We reserve the right to modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect.
